Diocese of San José Safe Environment Requirements

 

The Diocese of San José remains steadfast in our commitment to the safety and well-being of our children and vulnerable adults. We must all remain vigilant in order to protect our youth and most vulnerable. As outlined in the Charter for the Protection of Children and Young People, we recognize that clergy, diocesan personnel, volunteers, parents, and youth play a critical role in safety and prevention. Bearing this in mind, it is important that we are all aware of our Safe Environment requirements and responsibilities as delineated in diocesan procedures, policies, and codes of conduct.

All clergy and diocesan personnel, as well as adult volunteers – 18 years-old or older – who serve in any capacity with children or vulnerable adults, must complete the following requirements:

1. All personnel, including clergy and volunteers, must submit the proper background screening and clear the criminal history check prior to engaging in ministry or employment. Employees and clergy must submit a Live Scan Fingerprint submission through the California Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI). Volunteers also must submit the proper background screening via Live Scan or Online Background Check. 2. All personnel, including clergy and volunteers, must complete the appropriate Diocesan Safe Environment training course to learn how to recognize and report abuse or misconduct prior to engaging in ministry or employment. Thereafter, Diocesan Safe Environment training must be renewed every three (3) years. Training is available exclusively via the VIRTUS online learning management system (www.virtusonline.org). The training is available in English, Spanish, Vietnamese, and Korean. 3. All personnel, including clergy and volunteers, must understand their reporting responsibilities as it pertains not only to Diocesan policy, but also with regard to one’s mandated and ethical reporting requirements.

Beyond the Church’s call to action, there are state requirements that must be upheld as well. Under California State law, all parish and school personnel, including clergy, are Mandated Reporters and are required by California law to report any reasonable suspicion of child abuse, sexual or otherwise, to civil authorities. Failure to report a reasonable suspicion of child abuse or neglect is considered a misdemeanor and is punishable in California by six months in jail and/or up to a $1,000 fine. Additionally, adult volunteers are considered Ethical Reporters. It is the responsibility of Ethical Reporters to report any suspicions of abuse to a diocesan staff member on-site, who is then responsible for reporting the incident to the appropriate authorities immediately (or as soon as practically possible within 24 hours). However, anyone who has reason to believe or suspects that a child has been or is being abused should report their suspicions to civil authorities.

Youth also play a vital role in safety and prevention. Students in our Catholic Schools and Catechetical Programs participate in a VIRTUS Catholic Safe Environment Curriculum lesson every year which is founded on the principles of appropriate relationship boundaries in the broader context of Christian values. All lessons are age-appropriate and empower children to begin to recognize inappropriate behaviors and tell a safe adult.  Parents are encouraged to continue the conversation at home and can find helpful resources and lesson plans on the dioceses’ website at https://www.dsj.org/protecting-gods-children/virtus-resources-for-teachers-catechist/.

Chancellor – (Full-Time) – Diocese of Oakland

Position Summary

The ministry of the Chancellor, in the spirit of collaboration and accountability, supports the Bishop in his role as teacher and shepherd by working to provide a work situation that enables all employees and volunteers to witness faithfully to Christ and serve their neighbor to the best of their ability in the various ministries they perform.

Key Responsibilities

· Serve as a member of Bishop’s Administrative Council (BAC).

· Supervise the work of the following diocesan departments:

➢ Department of Communication – Director

➢ Department of Mission Advancement – Director

➢ Department of Faith Formation and Evangelization – Director

➢ Catholic Youth Organization and Boy Scouts (CYO) – Director

➢ Victims Assistance Coordinator and Diocesan Review Board – Coordinator

➢ Diocesan Archivist – Archivist

· Serve as Bishop’s Board representative on the following organizations:

➢ Catholic Charities of the East Bay (including Executive and Finance Committees)

➢ Lumen Christi Academies (includes two committee assignments)

➢ Catholic Telemedia Network

· Serve as a Bishop’s staff liaison to the Racial Justice Task Force

· Maintain archives, records, and official seal of the Diocese.

· Prepare statistical and informational reports and publications

➢ Annual and mid-term updates for the Official Catholic Directory (PJ Kennedy & Sons)

➢ Annual update for the Ordo (JS Paluch)

➢ Annual General Statistical Questionnaire (Annuario Pontificio)

➢ Quinquennial Report

Other statistical data as requested from various outside agencies

· Responsible for publishing accurate information for the Diocesan Directory

· Oversee all activities related to investigation and healing of clergy sexual abuse allegations:

o Prepare reports and keep records of sexual abuse investigations conducted

o Keep records of lawsuits filed and arbitration offers made

o Maintain clergy “sensitive issues” files

o Verify and submit USCCB annual audit reports and triennial on-site audit report

o Verify and submit annual CARA reporting

· Miscellaneous

➢ Review and adjudicate requests by extern priests for ministry in the Diocese of Oakland.

➢ Coordinate and verify priest’s completion of safe environment training and fingerprinting required for faculties.

➢ Assemble official documents necessary for faculties for priests and forward to Canon Law Department.

➢ Prepare and distribute priest and permanent deacon assignment letters.

➢ Prepare letters of good standing, cruise chaplain letters, and celebrets for priests with assignments in the Diocese of Oakland.

➢ Maintain official files on all priests, living and dead, who have served in the Diocese.

➢ Maintain ordination records; prepare ordination certificates for incardinated priests/transitional deacons ordained in the Diocese of Oakland.

➢ Maintain National Clergy Alert List.

➢ Conduct biennial Presbyteral Council elections; prepare appointment letters for members elected.

➢ Provide immigration support for international priests sponsored by the Diocese.

➢ Review nominations for Diocesan Medal of Merit and coordinate production of medal and citation.

➢ Collaborate with Canon Law Dept. to formulate Parish Administration Agreements with Religious Communities; maintain Parish Administration Agreement files.

➢ Assist with application process for new listings in the Official Catholic Directory.

➢ Prepare 501(c)(3) packets for entities falling under the Group Ruling.

➢ Coordinate with police and local government officials concerning problems and needs of parishes requiring their assistance.

➢ Accept any other duties or projects as assigned by the Bishop.

Required Education and Experience

The position of Chancellor requires the following education and experience:

· Bachelor’s degree and professional education, graduate level studies, or graduate degree in education, social work, psychology, law, public administration, business or non-profit administration, human resources, or health care

· A professional background with an excellent track record

· Minimum ten years work experience with progressively more important responsibilities, plus five years executive management and administrative experience, including project development, implementation and management, in any one or more of these areas: education, social work, law, public administration, business or non-profit sector management, health care, or human resources

Required Knowledge, Skills and Abilities:

· Excellent oral and written communication skills, including public speaking, presentations, large and small group facilitation, training, and workshops

· Ability to supervise employees & prepare annual performance evaluations

Compensation and Benefits

Compensation to be comparable to other Catholic institutions of this size in communities with comparable costs of living, negotiable based upon experience. Faith Formation Associate – (Temporary, Part-Time) – Chancery Office, San Jose

POSITION SUMMARY: Works with the Director of the Office of Faith Formation to provide assistance and support to Catechetical Directors in the following areas: catechetical resources, retreats, recognition, and networking.

ESSENTIAL DUTIES AND RESPONSIBILITIES INCLUDE THE FOLLOWING (and other duties as assigned):

Language Skills: Ability to read, write and speak fluent English and Spanish at a professional level. Ability to relate and communicate with a wide range of ethnic and cultural communities. Excellent composition, writing, and presentation skills. Spanish or Vietnamese required.

 Technical Skills: Microsoft Office 365, Google Drive, Adobe Suite, WordPress, Social Media platforms.

Victims Assistance Coordinator – (Full-Time) – Diocese of Oakland

Description Overview

The ministry of the Victims Assistance Coordinator seeks to protect and preserve the sacred nature of the relationship between the Church, its leadership, and its people. The Victims Assistance Coordinator’s mission supports the Bishop in his pastoral and administrative responsibilities for outreach and protection of children, youth, and vulnerable adults.

The Victims Assistance Coordinator plays a vital role in developing, coordinating, facilitating, managing, organizing, implementing, and coordinating the response of the Diocese to sexual misconduct.

Primary Functions

  • Direct the Diocesan outreach program to survivors of clergy sexual abuse.
  • Work closely with the Bishop and the Diocesan Review Board to coordinate the work of preventing and resolving incidents of sexual misconduct.

Essential Duties and Responsibilities

  • Support the Bishop in his pastoral responsibilities for outreach to victims of clergy sexual abuse and in his administrative responsibilities for protection of children, youth, and vulnerable adults.
    • Implement the Bishops Charter of 2002 (and its updates) for the Protection of Children and Young People.
    • Act as staff representative on the Diocesan Review Board to provide input on policies, procedures, investigations, and recommendations.
      • Develop the agenda
      • Make, receive, and follow through with Board recommendations
  • Keep records of the proceedings of the Review Board
    • Maintain policies and procedures for sexual misconduct
    • Work with survivors of clergy abuse to ensure compliance with the Charter and diocesan policies
  • Act as Bishop’s delegate for sexual misconduct issues involving clergy or Diocesan employees.
  • Respond pastorally and immediately (within 24 hours) to all individuals coming forward with allegations of child abuse or sexual misconduct against any individual working with the Diocese in conformity with civil law and Diocesan policies.
  • Respond effectively and immediately (within 24 hours) to any allegation of child abuse or sexual misconduct in conformity with civil law and Diocesan policies.
  • Work with victims of clergy sexual abuse to coordinate counseling services and pastoral care.
  • Coordinate the work of the Outreach Ministry (e.g., Healing Garden events, multi-diocese outreach, public relations, and others).
  • Staff bi-monthly support ministry, No More Secrets.
  • Prepare reports and keep records of investigations conducted.
  • Keep records of lawsuits filed.
  • Maintain sensitive issues clergy files.
  • Oversee monitoring of priests on prayer and penance.
  • Collaborate with the Safe Environment Coordinator and Program.
  • Proactively identify risks to the protection of children, adolescents, and adults, and suggest improvement to systems and policies.
  • Maintain a regular communication program and work collaboratively with the Bishop, the Diocesan Review Board, all Diocesan personnel, and all other individuals and entities that become involved with or are related to the work of the Victims Assistance Coordinator.
  • Facilitate “listening sessions” or public information meetings held in the Diocese.
  • Coordinate any necessary healing sessions for affected parish communities.
  • Periodically update research and Diocesan policies on all issues regarding sexual misconduct of clergy, employees, and volunteers of the Diocese of Oakland.
  • Coordinate with police and local government officials concerning problems and needs of parishes needing their assistance.
  • Prepare reports for the annual USCCB Safe Environment Compliance data collection audit.
  • Prepare reports for the triennial USCCB Safe Environment Compliance on-site audit.
  • Collect data for the annual Center for Applied Research in the Apostolate Survey of Allegations and Costs (CARA) report.
  • Other duties or projects as assigned by the Bishop or the Chancellor.
